The Privacy Policy for Virgo Guides.

1. Introduction

This Privacy Policy describes the practices of Melochora LLC (“Virgo Guides,” “we,” “us,” or “our”) regarding information we collect and the choices available to you regarding such information. For purposes of this Privacy Policy, unless otherwise stated, “information” or “personal information” means information relating to an identified or identifiable individual.

Virgo Guides is a professional tool for college counselors. It generates college-counseling-style astrological profile outputs and college planning recommendations for a counselor’s review. The people who create accounts and use the Service are college counselors (“Users” or “you”). Counselors may also enter limited information about the students they advise; those students are Data Subjects and are addressed separately in the Student Information Submitted by Counselors section below.

This Privacy Policy applies to information we collect where we control the purposes and means of processing, specifically information we collect through any of our websites, apps, emails, or other online services that link to this Privacy Policy (the “Service”) or other sources identified below. Please note that your use of the Service is subject to our Terms of Service, which contain additional terms — including the astrology disclaimer and counselor authorization representations referenced in this Policy.

This Privacy Policy does not apply to:

  • the practices of third parties we do not control;
  • information collected in the context of your job application or employment with us; and
  • information that has been anonymized or, to the extent permitted by law, deidentified.

2. Collection

This section describes the information we collect and how we collect it.

Information You Provide through the Service

When you use the Service, you may be asked to provide information to us, such as when you create or verify an account, run a preview on your own birth details, add students to your roster, or contact support. The categories of information we collect in this context include:

  • Contact identifiers, including your name and email address. We use passwordless, magic-link authentication — we do not collect or store account passwords.
  • Your own birth details, including your date of birth, time of birth, and place of birth, when you run a preview of the Service on yourself to create your own astrological profile output.
  • Student Records. Information you choose to enter about a student you advise, limited to the student’s first name, last initial, date of birth, time of birth, and place of birth. See Student Information Submitted by Counselors and Data Minimization.
  • Counselor Notes. You may enter freeform notes about a student. These notes are used to guide the outputs the Service generates about that student and may include whatever information you choose to type. Please do not enter more than is necessary for this purpose, and do not enter special categories of information you are not authorized to submit. We use Counselor Notes solely to generate the requested outputs for you.
  • Content, including content within any messages you send to us, such as feedback, questions, or support requests.

Information from Your Browser or Device

When you use the Service, we and providers we work with automatically collect information from your browser or device. The categories of information we automatically collect in this context include:

  • Device identifiers, including your device’s IP address.
  • Device information, including your device’s operating system and browser (e.g., type, version, and configuration) and regional and language settings.
  • Internet activity, including information about your interactions with the Service, such as the features you use and pages you visit.
  • Non-precise location data, such as location derived from an IP address at a city or postal-code level.

This information is collected through cookies and similar technologies incorporated into the Service:

  • Essential cookies. We use a small number of cookies that are necessary to operate the Service, including a cookie that maintains your signed-in session and a cookie used to associate a preview you generate before signing up with your account once you sign in.
  • Analytics and error-monitoring technologies. We may use analytics and error-monitoring services to understand how the Service is used and to detect and fix technical problems. Where we use these technologies, we use them for measurement, product improvement, and security — not for advertising or for building profiles about individuals.

We do not use advertising cookies or pixels, and we do not permit third parties to collect information through the Service to serve you targeted advertising.

Sensitive Information

Some of the information we collect — in particular date, time, and place of birth — may be considered sensitive personal information under applicable law. We collect, use, and disclose this information only for the specific service purpose described in this Policy. See Sensitive Personal Data.

3. Purposes for Collection and Use

Our purposes for collecting and using information include:

  • Providing services. We collect and use information to operate the Service, establish and maintain your account, generate astrological profile outputs and college application process recommendations for your review, and provide support.
  • Communications. We collect and use information to communicate with you about your account, including sign-in (magic-link) emails, security alerts, changes to policies, and other transactional messages. If we send optional product or marketing emails, we will offer you a way to opt out.
  • Security and enforcement. We collect and use information to prevent, detect, investigate, and address fraud, security incidents, breach of our policies or terms, or other threats or harm.
  • Improvements. We collect and use information to develop, maintain, and improve the Service. We do this using aggregated or deidentified information wherever practicable. We do not use User or Student information to train, fine-tune, or otherwise develop artificial intelligence or machine-learning models.
  • Analytics. We collect and use information to understand trends, usage, and activity so we can improve the Service.
  • At your direction or with your consent. We collect and use information for additional purposes where you direct us to use it in a certain way, or with notice to you and your consent.

We do not use User or Student information for model training, for building individual profiles, for advertising or targeted advertising, or for any secondary purpose beyond providing and improving the Service as described in this Policy. Where we deidentify information, we commit to maintain and use it in deidentified form and not to attempt to reidentify it.

4. Disclosure

We disclose the information we collect for the purposes described in this Privacy Policy. We do not sell or share your personal information, and we do not disclose Student Records for any purpose other than providing the Service to the counselor who submitted them. The categories of persons to whom we disclose information include:

  • Service providers. We work with vendors that process information on our behalf so we can operate the Service. These include providers of:

    • cloud hosting and application infrastructure;
    • database and authentication services;
    • astrological chart-data services (to convert birth details into chart data);
    • artificial intelligence / large language model services (to generate the interpretive text of an output);
    • geocoding and mapping services (to convert a place name into geographic coordinates);
    • email delivery (including magic-link sign-in messages); and
    • analytics and error-monitoring.

    To the extent required by law, we contractually prohibit our service providers from processing information they collect on our behalf for purposes other than performing services for us.

  • Recipients in a merger or acquisition. We may disclose information in connection with, or during negotiations of, any proposed or actual merger, acquisition, financing, reorganization, or sale of all or a portion of our business or assets.

  • Recipients for security and enforcement. We may disclose information to comply with the law or legal process, respond to lawful requests by public authorities, and protect the rights, property, life, health, security, and safety of us, the Service, or anyone else.

  • Recipients at your direction or with your consent. We disclose information where you direct us to or with notice to you and your consent.

We identify our service providers by category rather than by name. We may update the specific providers within each category from time to time as we operate and improve the Service.

5. Student Information Submitted by Counselors

This section is central to how Virgo Guides works. Counselors — not students — are the direct users of the Service. Where a counselor enters information about a student, that student is a Data Subject, and the information is a Student Record.

  • We store only what counselors enter. The Service does not independently collect, obtain, or infer information about students from any other source. Student Records consist solely of what a counselor types into the Service: first name, last initial, date of birth, time of birth, place of birth, and any Counselor Notes.
  • Student information is used only to generate the counselor’s outputs. We use Student Records and Counselor Notes solely to generate astrological profile outputs and college planning recommendations for the counselor who entered them. We do not use student information to train or develop AI models, build individual profiles, conduct independent research, serve advertising, or for any other secondary purpose.
  • Counselors are responsible for authorization. By entering student information, you represent that you have appropriate authorization to do so — whether through your institution’s data-governance policy, applicable parental consent, or the consent of a student who is 18 or older. Melochora LLC does not independently verify counselors’ authorization to submit student data.
  • Counselors are responsible for outputs. You are solely responsible for how you use, store, share, or act on any outputs the Service generates.
  • Retention and deletion. We retain Student Records as described in Retention. You can delete an individual student’s profile at any time from your dashboard, which deletes that student’s record, and deleting your account deletes the student records associated with it. You may also request deletion by contacting us at support@melochora.com.

6. Data Minimization

The Service is designed to run on a minimal amount of information. We ask you to enter only a student’s first name, last initial, date of birth, time of birth, place of birth, and the Counselor Notes needed to guide the output. Please do not enter more than this.

In particular, please do not enter:

  • a student’s full name, contact details, address, or government identifiers;
  • academic records, grades, disciplinary records, health or disability information, financial information, or other detailed educational records; or
  • any information about a student that you are not authorized to submit to a third-party tool.

Entering only what the Service needs protects the students you advise and reduces the amount of sensitive information held anywhere. If you provide information we did not request, you may delete it, and you may contact us at support@melochora.com for assistance.

7. FERPA and Educational Records

Users who input student information in connection with their role at an educational institution are solely responsible for ensuring their use of this Platform complies with applicable laws governing student educational records, including the Family Educational Rights and Privacy Act (“FERPA”) where applicable, as well as any institutional data-governance or data-privacy policies that apply to them. Melochora LLC does not represent that use of this Platform satisfies any institutional data-governance requirements, and we are not a party to any agreement between you and your institution.

8. Sensitive Personal Data

We collect date, time, and place of birth — for both counselors (when they preview the Service on themselves) and students (as entered by counselors) — solely for the purpose of generating astrological profile outputs and college planning recommendations. This information is considered sensitive personal data under several state privacy laws (including in Colorado, Virginia, and Texas, among others). We collect and use it only for the specific service purpose described in this Policy. We do not use birth information for profiling, advertising, or any secondary purpose, and we do not sell or share it.

9. Your Privacy Choices

This section describes the choices available to you regarding your information. If you are a resident of the U.S., see our U.S. State-Specific Disclosures for additional rights.

Communications

We use passwordless, magic-link sign-in, so some emails are necessary to use the Service. You can control communications from us as follows:

  • Transactional and sign-in emails. Messages such as magic-link sign-in emails, security alerts, and important account or policy notices are necessary to provide the Service, and you cannot opt out of them while you have an account.
  • Optional emails. If we send optional product or marketing emails, you can stop receiving them by following the unsubscribe instructions in the email.

Accounts

You can delete your account at any time from your account settings. Deleting your account also deletes the student records you created, in accordance with our Retention practices. You may also contact us at support@melochora.com to request access to or correction of your information, or to request deletion if you prefer.

Browser and Device Controls

  • Cookies. You may be able to manage cookies through your browser settings. Because we rely on an essential session cookie to keep you signed in, blocking or deleting cookies may prevent parts of the Service from working. If you use multiple browsers, you will need to adjust each one separately.
  • Preference signals. Your browser or an extension may allow you to transmit Do Not Track or other preference signals. Except as required by law, we do not respond to these signals; however, we do not engage in the targeted advertising or sale of personal information that such signals typically address.

10. Children

This Platform is designed for use by adult professional counselors. We do not permit minors to create accounts or directly use the Service, and the Service is not directed to children. Where counselors enter information about minor students in the course of their professional work, such information is submitted by the adult counselor-user and is governed by the Student Information Submitted by Counselors provisions of this Policy. Counselor-users represent that they have appropriate authorization to submit such information.

We do not knowingly collect personal information directly from children (as that term is defined by the U.S. Children’s Online Privacy Protection Act, or “COPPA”). If you are a parent or guardian and believe a child has provided information to us directly, please contact us as set out in Contact Us, and we will address the information in accordance with applicable law.

11. Security

We implement and maintain reasonable administrative, physical, and technical safeguards designed to protect information about you from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. Please note that transmission via the internet is not completely secure, and we cannot guarantee the security of information about you.

12. Retention

We retain information for as long as reasonably necessary for the purposes for which it was collected, and as necessary to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements. In particular:

  • Counselor account information. We retain your account information for as long as you maintain an account with us. When your account is deleted, we delete or deidentify your account information in accordance with our practices, subject to legal retention obligations.
  • Student Records. We retain a student’s record for as long as you remain a user and the student’s profile has not been deleted, so that we can continue to provide astrological readings and recommendations about that student for you. A student’s record is deleted when that student’s profile is deleted or when your account is deleted.
  • Unclaimed preview reports. When a prospective counselor generates a preview before creating an account, we store the finished preview so it is not lost if they sign up. If the preview is not claimed by signing in, it is automatically deleted after 7 days.

13. Geographic Scope and International Users

The Service is intended for users located in the United States only. It is not directed to, offered to, or intended for individuals located in the European Economic Area (EEA), Switzerland, or the United Kingdom, and we do not permit residents of those regions to use the Service. By using the Service, you represent that you are located in, and are accessing the Service from, the United States.

We are based in and operate the Service from the United States. All information we collect is stored and processed in the United States.

14. Changes to this Privacy Policy

We reserve the right to revise and reissue this Privacy Policy at any time. Any changes will be effective upon posting of the revised Privacy Policy, and we will update the “Effective date” above. Your continued use of the Service after changes take effect indicates your acceptance of the revised Policy. If the changes are material, we may provide additional notice to you, such as by email or a prominent notice on the Service.

16. U.S. State-Specific Disclosures

California

This section applies to California residents.

Notice at Collection. At or before the time of collection of your personal information, you have the right to receive notice of our data practices. Those practices are as follows:

  • Collection. The categories of personal information we have collected in the past 12 months, and the sources from which we collect them, are set out in the Collection section above.
  • Purpose. The business and commercial purposes for collecting and using personal information are set out in the Purposes for Collection and Use section above.
  • Disclosure. The categories of persons to whom personal information is disclosed for business purposes are set out in the Disclosure section above.
  • Sales and Shares. We do not sell or share personal information as those terms are defined under California law, and we do not use personal information for cross-context behavioral (targeted) advertising.
  • Sensitive Personal Information. Some of the information we collect (such as date, time, and place of birth) may be considered sensitive personal information under California law. We collect, use, and disclose it only for the permitted purposes described in this Policy — namely, to provide the Service — and not to infer characteristics about you. See Sensitive Personal Data.
  • Retention. The criteria we use to determine retention periods are set out in the Retention section above.

Requests. You have the right to (i) know the personal information we have collected about you, including the categories of sources, the business or commercial purposes for collecting it, the categories of third parties to whom we disclosed it, and the specific pieces of personal information collected; (ii) correct inaccurate personal information we maintain about you; and (iii) delete personal information we have collected from you. These are verifiable rights: we must verify your identity before fulfilling them. To exercise any of these rights, submit a request to support@melochora.com. We will confirm receipt of and respond to your request consistent with applicable law. You have the right not to be discriminated against for exercising your rights, and you may use an authorized agent (with written, signed proof of authorization). We do not sell or share personal information, and we do not use or disclose sensitive personal information beyond the purposes permitted under California law.

Consensus States

This section applies to residents of any U.S. state, other than California, that has enacted a comprehensive state privacy law (each, a “Consensus State”), including Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia.

Data Practices. Our practices regarding the collection, use, disclosure, and retention of your personal data are set out in the main Privacy Policy above. We do not sell or share your personal data, and we do not process personal data for targeted advertising. We do not process personal data for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers. Some of the personal data we collect (birth information) may be considered sensitive personal data under applicable law; we process it only to provide the Service.

Requests. You have the right to: (i) confirm whether we are processing your personal data and access it; (ii) correct inaccuracies; (iii) delete your personal data; and (iv) obtain a portable copy of personal data you previously provided to us. If you are a Minnesota or Oregon resident, you also have the right to obtain a list of the specific third parties to which we have disclosed personal data; if you are a Delaware or Maryland resident, a list of the categories of third parties; and if you are a Connecticut or Rhode Island resident, a list of the specific third parties. To exercise any of these rights, submit a request to support@melochora.com. We must verify your identity before fulfilling a request. You have the right not to be discriminated against for exercising your rights, and you may appeal a decision by writing to us at support@melochora.com; if we deny your appeal, you may contact your state Attorney General.
